    Case File: 0019-496

    Charges: Cultivation by adult of  cannabis plants contrary to Section 12(6)(a) of the Cannabis Act

    Facts: Police obtained a warrant to enter client’s commercial premises and to search for illegal cannabis cultivation.  Upon entering the premises, police located two 14 x 24-foot racks with three shelves containing five to six trays of plants with an estimated 90 trays in total, containing numerous plants each.  At the time of the search, the client did not have a valid license to cultivate cannabis. 

    Result: After extensive negotiations, Crown ultimately elected to enter a Stay of Proceedings on this matter.

    Charges: Fraudulently Obtain Transportation contrary to Section 393(3) of the Criminal Code and Possession of a Controlled Substance contrary to Section 4(1) of the Controlled Drugs and Substances Act

    Facts: The client had taken a taxi home following a night out on the town. When they reached their destination, a disagreement arose with respect to payment of fare. Police were called and subsequently attended. Police searched the client incidental to arrest and located illicit drugs on their person.  They were charged and issued with a Promise to Appear.

    Result: Client was successfully referred to the Alternative Measure Program.  The client successfully completed the program and Crown entered a Stay of Proceedings in relation to both counts.

    Charges: Sexual Interference involving a Minor contrary to Section 151 of the Criminal Code and Sexual Assault contrary to Section 271 of the Criminal Code

    Facts: Client was involved in a romantic dating relationship with a person who was  four years their junior and under the age of sixteen years. One incident of sexual activity between the couple was reported to police by a third party medical professional. Client was arrested and interviewed by police.  During the interview, the client provided a full statement, admitting to the incident in detail. 

    Result: After extensive negotiations with Crown on issues including but not limited to voluntariness, capacity and knowledge, Crown elected to enter a Stay of Proceedings.

    Case File: 0018-262

    Charges: Theft Under $5000 contrary to Section 334 of the Criminal Code

    Facts: The client was visiting another major city, outside the province, when they were stopped and arrested for shoplifting in a shopping mall.  The client subsequently returned to the Lower Mainland and retained counsel.

    Result: Counsel had the client’s out-of-province charges waived to Vancouver.  Once the charges were successfully waived, counsel was able to have the matter referred to the Alternative Measures Program.  The client completed ten hours of community work service.  Charges were subsequently dropped and a Stay of Proceedings was entered.
